Terms of Service — CompareMyKart

These Terms of Service ("Terms") form a legally binding agreement between you ("User", "you") and CompareMyKart ("we", "our", "the App"). They govern your access to and use of the CompareMyKart mobile application and any related backend services (collectively, the "Service").
By installing or using the App, you confirm that you have read, understood, and agreed to these Terms. If you do not agree, do not install or use the App.
1. Eligibility
You must be at least 18 years old and a resident of India to use CompareMyKart. By using the Service, you represent and warrant that you meet these criteria.
2. What CompareMyKart offers
CompareMyKart is a price-comparison tool. When you have items in your cart on a supported food-delivery app (e.g. Zomato), the App helps you compare the equivalent total cost on other delivery platforms (e.g. Swiggy, Magicpin, EatClub) so you can choose the cheaper option.
CompareMyKart does not:
- Place orders on your behalf
- Process payments
- Deliver food
- Hold inventory
- Provide customer service for any delivery platform
The actual purchase, delivery, refund, and any food-quality issue is strictly between you and the delivery platform / restaurant. CompareMyKart is not a party to that transaction.
3. Your accounts on delivery platforms
To compare prices on a given platform (Swiggy, Magicpin, etc.), you must already have a valid, active account on that platform, registered under your own phone number. CompareMyKart does not create accounts for you.
When you initiate a comparison on a platform, CompareMyKart helps you authenticate with your existing account using that platform's own OTP-based login flow. You are responsible for the security of your accounts on each delivery platform. You agree:
- Not to use CompareMyKart with accounts you don't own.
- To log out of CompareMyKart from inside the App if you suspect any unauthorised access on a comparison platform.
CompareMyKart's role is purely to facilitate price discovery on your direct instruction, each time you initiate a comparison.
4. Acceptable use
You agree to use the Service only for lawful purposes. You will not:
- Use the App to violate the Terms of Service of any delivery platform.
- Use the App to spam, abuse, or overload any delivery platform with automated queries.
- Reverse-engineer, decompile, or attempt to extract source code of the App except where allowed by law.
- Resell, rent, or sublicense access to the App.
- Use the App on a device that is rooted, jailbroken, or running a modified Android build, in a way that compromises security.
- Use the App for fraud, money-laundering, or any criminal activity.
We may suspend or terminate your access at any time if we reasonably believe you have violated these Terms.
5. Service availability
We strive to keep CompareMyKart available 24×7, but we make no guarantee of uptime. The Service depends on:
- Public APIs of third-party delivery platforms, which may change without notice
- Internet connectivity from your device
- Cloud infrastructure providers
Any delivery platform may at any time change its API, block automated requests, or revoke our authentication. When this happens, CompareMyKart may temporarily fail to fetch prices for that platform until we update the App. We are not liable for such disruptions.
6. Pricing and accuracy of comparisons
CompareMyKart fetches prices and coupons at the moment of your tap, directly from each delivery platform. We do our best to match items accurately across platforms, but:
- Item names and variant options differ between platforms; we use heuristic matching.
- Coupons are user-specific and time-bound; a coupon shown one minute ago may not apply now.
- Delivery charges, taxes, and platform fees vary in real time.
You agree that CompareMyKart's price displays are estimates and not guarantees. Always verify the final total on the delivery platform's checkout page before placing your order. We are not liable for any difference between our displayed estimate and the platform's checkout total.
7. Coupons and discounts
If a coupon is shown as "applied" on a competing platform, it means CompareMyKart was able to apply that coupon programmatically against your account at that moment. Many coupons are first-order-only or single-use. They may not apply on your next attempt, and CompareMyKart cannot reissue them. You are responsible for understanding coupon terms displayed by each platform.
8. Intellectual property
The App, its source code, trademarks, designs, and logos are the property of CompareMyKart and its publisher. You receive a personal, revocable, non-transferable, non-exclusive licence to use the App on your personal Android device for the purposes described here. You receive no other rights.
Trademarks of third-party delivery platforms remain the property of their respective owners. CompareMyKart is not affiliated with or endorsed by any delivery platform.
9. Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY OF DATA.
We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any information shown will be complete or accurate at the time of display.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CompareMyKart, ITS PUBLISHER, OFFICERS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, REVENUE, GOODWILL, OR PROFITS, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.
OUR TOTAL AGGREGATE LIABILITY FOR DIRECT DAMAGES, IF ANY, SHALL NOT EXCEED ₹1,000 (RUPEES ONE THOUSAND) OR THE FEES YOU HAVE PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, WHICHEVER IS LOWER.
11. Indemnity
You agree to indemnify and hold harmless CompareMyKart and its publisher from any claim, demand, damage, or expense (including reasonable attorneys' fees) arising out of:
- Your breach of these Terms
- Your misuse of the Service
- Your violation of any law or third-party right (including the Terms of Service of a delivery platform)
12. Termination
You may stop using the Service at any time by uninstalling the App and emailing us to delete your account.
We may suspend or terminate your access:
- Immediately, on your breach of these Terms
- With reasonable notice, for operational reasons (for example, the App being discontinued)
- Without notice, on instruction of a court or competent authority
Sections that by their nature should survive termination (intellectual property, disclaimer, limitation of liability, governing law) survive.
13. Privacy
Your use of the Service is also governed by our Privacy Policy at https://comparemykart.com/privacy. Please review it. By using the Service, you consent to the data practices described there.
14. Governing law and disputes
These Terms are governed by the laws of India. Any dispute arising out of these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts in Ghaziabad, Uttar Pradesh, India.
Before initiating any legal action, you agree to first contact us in good faith at support@comparemykart.com to attempt resolution. We will respond within 15 working days.
15. Changes to these Terms
We may update these Terms from time to time. The "Last updated" date at the top reflects the most recent revision. Material changes will be notified within the App at least 7 days before they take effect. If you do not agree to a change, your sole remedy is to stop using the Service.
